The series IC 814: The Kandahar Hijack, directed by Anubhav Sinha, dramatizes the 1999 hijacking of Indian Airlines Flight IC-814. The six-episode mini-series, which premiered on August 29, 2024, portrays the harrowing ordeal of passengers as the flight, en route from Kathmandu to Delhi, was diverted to Kandahar. The series aims to encapsulate the terror experienced during this significant event in Indian aviation history.The series, which features notable actors such as Vijay Varma, Dia Mirza, and Naseeruddin Shah, has faced legal challenges.
The recent one is from the news agency ANI, who has alleged that the makers have used archival footage without permission. This lawsuit has brought to light broader discussions about creative liberties in storytelling, historical representation, and the implications of media portrayals of sensitive events. According to a report by Bar and Bench, ANI has filed a lawsuit against Netflix and the creators of IC 814, demanding the removal of four episodes that allegedly feature footage of prominent figures, including then Prime Minister Atal Bihari Vajpayee and General Pervez Musharraf, without proper licensing.
According to ANI’s counsel, Sidhant Kumar, the unauthorized use of their copyright material and trademark has resulted in tarnishing their brand’s reputation amidst the series’ criticisms. The Delhi High Court has acknowledged the complaint and scheduled a hearing for the matter, marking a significant legal confrontation for the streaming giant.
The series has drawn attention, not only for legal reasons but has also faced criticism for its portrayal of hijackers, with some arguing that it misrepresents the real terrorists involved. In response, the Ministry of Information and Broadcasting had summoned Netflix India’s content chief, Monika Shergill, to address these concerns. This led to the addition of a disclaimer in the opening credits, which included the actual names of the hijackers to clarify their identities and address the backlash.
